Terms and conditions

1. Provider and scope

These terms apply to children’s gymnastics classes provided by Lars Fehlert Sportkurse, Wiener Weg 6, 50858 Cologne, Germany (“KITUWI”).

2. Registration and contract

Submitting the online form constitutes a binding offer to book the selected class for a fee. The contract is formed when KITUWI personally confirms the place by email. An automated receipt is not a place confirmation.

3. Class and fee

The schedule, duration and total fee are shown during registration. The current series comprises 13 dates. The total fee is €208 for 45-minute classes and €247 for 60-minute classes. Fees are adjusted when joining an ongoing series by agreement.

4. Payment and cancellation

KITUWI issues an invoice after confirming the place. Withdrawal is possible in text form up to 14 days before the first date for a €10 administration fee. Later withdrawal up to one day before the start incurs 30% of the class fee plus €10, unless a lower loss is proven. There is no statutory right of withdrawal for leisure services on fixed dates under Section 312g(2)(9) BGB.

5. Missed dates and changes

Missing individual dates does not reduce the agreed fee. KITUWI may make reasonable changes to instructors, group composition or programme. If KITUWI cancels a date and cannot offer a replacement, the corresponding amount will be refunded or credited.

6. Health, supervision and liability

Relevant health conditions must be disclosed before class. Instructions and house rules must be followed. Parents retain supervision outside class time and during parent-and-child classes. Liability is unlimited for intent, gross negligence, injury to life, body or health and mandatory legal cases; otherwise statutory limitations apply.
